Chapter 8 Health and safety CHAPTER CONTENTS Safe, effective practice 248 The working space 248 SAFE, EFFECTIVE PRACTICE This encompasses a wide range of issues including the safety of the working environment, the teacher’s fitness for work, the appropriate application of exercise, protocols for ongoing referrals and the legal implications of good and ethical practice. Official guidance is available from a variety of sources, with which all teachers and trainers should be familiar. The Health and Safety Executive provides a Code of Practice as required by the Health and Safety Commission, under the auspices of the Secretary of State for Health. Although failure to comply with any of the provision of this Code is not in itself an offence, such failure to comply may be taken by a court in criminal proceedings as proof that a person has contravened a regulation or sections of the 1974 Act to which a provision relates. In such a case, however, it will be open to that person to satisfy the court that the regulation has been complied with in some other way. For up-to-date information on approved codes of practice it is advisable to refer to the most recent publication of Workplace Health, Safety and Welfare Regulations. There is an array of such publications issued by the Health and Safety Commission (HSC) and published and sold by The Stationery Office (TSO).
